On November 2, 2004, voters of Montana passed Initiative 148, which took effect immediately. The vote was 62% yes to 38% no. It eliminated criminal sanctions for medical cannabis authorized by a patient’s physician. Possession of as many as six cannabis plants is allowed.
Personal use possession of 60 grams or less of marijuana is a misdemeanor punishable by up to 6 months imprisonment and a fine of $100 – $500. A second offense is punishable by up to 3 years imprisonment and/or a fine up to $1,000. Possession of more than 60 grams is a felony punishable by up to 5 years imprisonment and/or a fine up to $50,000. Possession of any amount of marijuana with intent to distribute is a felony punishable by up to 20 years imprisonment and/or a fine up to $50,000.
